Correction of Registry Deed

The voluntary jurisdiction procedure also includes the procedure for correcting a notarial act as provided for in article 782 of the Civil Code.

The registry deed is a legal and official document issued by the registrar that certifies important events of the person it refers to such as birth, marriage and death.

In particular, the above article 782 of the Civil Code stipulates in pr. 3 that for the correction of a notarial deed, the provisions of the first paragraph are applied, i.e. a court decision is required, as well as for the attestation of a fact with the purpose of drawing up a notarial deed, following an application by anyone with a legal interest or the prosecutor from the magistrate's court of the registrar's district who has drawn up the rectifiable notarial deed.

Furthermore, Law 344/1976 "on notarial acts" stipulates in article 13 par. 1 that a court decision is required for the correction of a notarial act, while it adds in par. 2 that for errors in a notarial act which do not concern the place, day, month , year and time of their execution in the deed of confirmed event and as long as the deed is not attributed to the fraud of the accomplices, they can also be corrected after the permission of the Prosecutor of First Instance or, where there is no Prosecutor, of the Justice of the Peace, which is granted after investigation and verification of the actual data, upon request by anyone with a legal interest. Subsequently, in par. 3, it states that apparently inadvertent errors in the notarial act can be corrected without the permission of the District Attorney or the Justice of the Peace, by the competent registrar, after a previous investigation and verification of the facts by him, at the request of all having a legitimate interest.
